In short

What is Repossession Management?

Software that runs an auto repossession from assignment to the post-sale letter: clearing legal holds before a car is assigned, tracking it with the recovery agent, and after recovery running the state’s notice clock, the redemption window, the sale and the deficiency or surplus explanation. Repossession Management adds agents that do the searches, the clock arithmetic and the first drafts, while the recovery manager releases and signs.

The problem

Why a clean assignment can still be a wrongful repossession

Before a car is taken, someone has to prove nothing forbids it: no bankruptcy petition and its automatic stay, no borrower on active duty whose contract predates service, no deferral agreed on the phone, no payment still settling, no promise to pay in its window, no state cure period running, no open dispute. The servicing record says 60 days past due — but it can be hours behind a phone call, a card payment or a court filing.

Once the car is recovered, the state's clocks start: police notified where the state requires it, personal property inventoried and offered back, the notice of intent or notice of disposition mailed with the exact amount to reinstate or redeem, a sale no earlier than the law allows, then an explanation of any deficiency or surplus. By hand that runs across the servicing system, the bankruptcy index, the SCRA site, call notes, a vendor portal, a spreadsheet of state rules and mail-merge letters. A cancellation e-mailed to an agent who never confirmed it is a wrongful repossession waiting for Monday.

One case, step by step

One Monday, from the morning batch to a signed notice

Monday 12 October at Saltmeadow Auto Finance: a truck is 47 minutes from dispatch, 38 accounts wait for assignment, and a recovered F-150 in Fresno has started California’s clock. Here is what happens, screen by screen, in the working solution.

  1. 0109:12

Every car on one board of live clocks

    Renée Castellanos · Recovery manager

Renée opens the clock board: 32 clocks running, 2 stopped by a hold, four lanes — releasing to an agent, waiting periods, notice clocks and redemption windows. Next out is Darius Kemp’s 2021 Silverado, 71 days past due, located at home and going to Lone Star Lot Recovery’s 10:00 dispatch. The 05:30 re-check was clear on Sunday’s SCRA data.

“0 wrongful repossessions since 2 Mar”

  2. 0247 minutes to dispatch

Checked again before the truck goes — and the clock stops

    Bankruptcy and military checker

Renée presses Check now. Bankruptcy index: no filing. Hardship plans: none. SCRA status: active duty from Mon 12 Oct, Army Reserve orders. His contract of 9 Mar 2021 predates service, so the truck may not be taken without a court order. The ring turns grey, Lone Star acknowledges the stop at 09:13, and the next step is the SCRA desk.

“Hold — active duty per SCRA check this morning.” The nightly check could not have seen it: it ran on Sunday’s data.

  3. 031 min 08 s

    Batch RB-1012: 38 accounts, 8 holds each

    Three checking agents

The morning batch is 38 accounts in 7 states, $770,134 owed. Three agents run 94 bankruptcy and military searches on 38 borrowers and 9 co-borrowers, read 214 call notes and 72 hours of payments, and apply 7 states’ rules. 31 clear; 7 held — a deferral agreed by phone Friday at 15:22, a Chapter 13 filed Friday, a borrower on active duty since March 2025, a $412.00 payment still settling, a promise to pay, a Wisconsin cure period, an open dispute.

Every held account shows the rule, the source and what happens next. A held account is never sent to a recovery agent.

  4. 04Released

Only cleared accounts go out — and only when she releases them

    Renée Castellanos · Recovery manager

The assignment coordinator has split the 31 clear accounts across 8 recovery agents by region, $633,983 to recover. Renée reviews the split and releases the batch. Held accounts stay with their teams: the bankruptcy team, the SCRA desk, or a re-check on the date their deferral posts or their promise falls due.

“Your release, the time and the hold-check results for every account are written to the audit trail.”

  5. 05Every night at 05:30

Open assignments, re-checked while the car is still out

    Jordan Pike · Recovery specialist

All open assignments are tested against the 8 holds again each night. This morning the re-check suspended Gerald Owens — Chapter 7 filed Saturday — and flagged that Gulf Coast Recovery Group has gone 65 hours without acknowledging the cancellation for Monique Hart, who paid in full on Friday. Samuel Ibarra’s condition report and property inventory are still not in, 34 hours after his car was recovered.

Cancellations must be acknowledged within 4 hours, or they go to the recovery manager.

  6. 0651 seconds

Andre Whitfield’s truck is recovered — California’s clock starts

    Six agents

Case RC-26-04417: a 2021 Ford F-150 recovered in Fresno at 02:14 from an open lot, police notified at 02:51, no breach of the peace. The agents search bankruptcy and SCRA again, set the clock — notice by Wed 14 Oct under the 3-business-day policy, earliest sale Thu 29 Oct — and price the account: $2,978.60 to reinstate, $28,444.38 to redeem, an estimated deficiency of $5,384.38 at a $24,600 sale.

  7. 0708:05

The child seat and the tools go back, with no fee

    Renée Castellanos · Recovery manager

At 08:05 Andre calls Malik Henderson’s customer service team about his child seat and his tools. Six items are inventoried at the agent’s yard and held 60 days at no charge. Central Valley charges $75 to release property; under Saltmeadow’s policy the borrower never pays it, so Renée arranges the return with no fee.

“Central Valley charges $75 to release property · your policy: the borrower never pays it”

  8. 08Drafted

The notice of intent to dispose, every content checked

    Notice writer

The notice is drafted on the lender’s letterhead: when and where the truck was taken, where it is held, the four itemized charges to reinstate, the full amount to redeem, the date after which it may be sold and the deficiency liability. All 9 of 9 required contents in the California rule pack are ticked, each amount tied to a ledger line.

  9. 09Signed · day one

Signed and mailed certified, two days inside policy

    Renée Castellanos · Recovery manager

Renée signs with her password and the meaning of the signature — “Reviewed — send as drafted”. The notice goes by certified mail with an e-mail copy on Mon 12 Oct, and the redemption window opens until the sale. Her signature, the time, the amounts and the mailing number are written to the audit trail.

“The clock now counts to Thu 29 Oct; reinstatement stays open until the sale.”

  10. 10After the sale

Every balance explained line by line

    Sale and deficiency calculator

Nicole Barrett’s 2019 Camry sold at auction in Dallas for $18,900.00. She owed $17,322.50 and the costs of retaking, storing, preparing and selling came to $1,165.00, so the lender owes her a surplus of $412.50. The explanation and the refund are drafted and wait for Renée’s approval.

Built on the engine

6 agents. Each with one job, and hard limits.

Six specialist agents clear every hold, again just before each dispatch, and run every state clock; the recovery manager releases and signs.

Bankruptcy and military checker

Searches the national bankruptcy index and the SCRA status site for every borrower and co-borrower — on the batch, every night, and again before each dispatch — and keeps the certificate.

  • Never clears an account without both searches under 24 hours old
  • Compares the active-duty start with the contract date
  • Federal holds cannot be overridden
Account activity checker

Reads the servicing record, payment processors and call notes for deferrals, extensions, payments in flight, promises to pay, disputes and cancellation requests.

  • Never reads a promise or deferral as kept before its date
  • Cites the note or record for every hold
State rules checker

Applies the borrower’s state: right-to-cure notices and their periods, waiting periods, the lien on title, notice types, mailing deadlines and the earliest sale date.

  • Never sets a deadline later than the state rule or the stricter lender policy
Assignment coordinator

Routes released accounts to recovery agents by region, makes sure every cancellation is acknowledged, and reads recovery reports, condition reports and property inventories.

  • Never sends an assignment the manager has not released
  • Escalates every cancellation not acknowledged within 4 hours
Notice writer

Drafts the state’s notice after repossession with reinstatement and redemption amounts worked out from the ledger and the contract, and checks every required content.

  • Never sends without the manager’s signature
  • Every amount ties to a ledger line
Sale and deficiency calculator

Estimates sale proceeds before the sale, then works out the deficiency or surplus and drafts the explanation letter, with the refund for a surplus.

  • Never waives or demands a balance on its own
Recovery manager

Releases each batch and signs every notice; compliance co-approves overrides. The agents propose; a named person decides.

Ask in plain words

Ask about any account, hold or notice

The recovery team can ask about any borrower, hold, case or notice in plain words — or tell it what to do. Answers cite the records they rest on.

Why is Luis Ortega’s account held?

Luis is on active military duty since 3 March 2025 — the SCRA status certificate run today says so. His contract is dated 18 August 2023, before his service began. For a car bought on installment before service, federal law forbids repossession during service without a court order (50 U.S.C. §3952). The account is with the SCRA desk and cannot be overridden here.

Why did Darius Kemp’s clock stop?

Because the SCRA check this morning shows him on active duty from Mon 12 Oct — Army Reserve orders. The 05:30 re-check used Sunday’s SCRA data, so it could not see the orders; the pre-dispatch check pulls a certificate under 2 hours old. His contract of 9 Mar 2021 predates service, so the truck may not be taken without a court order.

What does Andre Whitfield need to pay to get his truck back?

Two ways: $2,978.60 to reinstate and keep the contract, or $28,444.38 to redeem — pay it off. Reinstating covers 3 missed installments of $816.20, $45.00 in late charges, the $425.00 repossession fee and 3 days’ storage at $20.00. Storage adds $20.00 a day after Wed 14 Oct; either option is open until the sale, not before Thu 29 Oct.

Return Andre’s child seat and tools today, with no fee

Booked. Central Valley holds six items from the truck, including the child seat and the tool chest Andre asked for at 08:05. He can collect them today at 15:00; I texted him the time. Central Valley’s $75 release fee is billed to Saltmeadow, not to Andre — your policy never charges a borrower for their own property.

Governance

Built for supervised work: every hold sourced, every notice signed, every step on the record.

Every hold cites its sourceA bankruptcy case number, an SCRA certificate, a call note with its time, a card-processor record or a state statute — every held account shows the rule, the source and what happens next.
A person releases every batchAgents recommend; they never assign, send, sell, waive or demand on their own. Nothing goes to a recovery agent until the recovery manager releases it, and only accounts the hold check cleared.
Federal holds cannot be overriddenBankruptcy and military holds stop the clock and move the account to its team. Any other override needs a reason and a second person: the recovery manager and the compliance reviewer.
Every notice is signedThe recovery manager signs each notice and each deficiency or surplus letter with a password and the meaning of the signature; the time, the amounts and the mailing number are recorded with it.
Checked again, right before dispatchEvery open assignment is re-checked each night at 05:30, and again 15 minutes before each release on a fresh SCRA certificate. A cancellation not acknowledged within 4 hours goes to the recovery manager.
Every step on the recordEach search, each agent step, each release, signature, property return and letter is on the activity trail with who, what and when; each notice names the state rule pack version it was checked against.

Questions

What recovery and compliance teams ask us.

What is repossession management software?

Software that runs an auto repossession from assignment to the post-sale letter: clearing legal holds before a car is assigned, tracking it with the recovery agent, and after recovery running the state’s notice clock, the redemption window, the sale and the deficiency or surplus explanation. Repossession Management adds agents that do the searches, the clock arithmetic and the first drafts, while the recovery manager releases and signs.

How does it help prevent wrongful repossessions?

Every borrower and co-borrower is tested against 8 holds — bankruptcy, military duty, deferral, payment in flight, promise to pay, dispute, state cure period and lien on title — before assignment, every night while the assignment is open, and again 15 minutes before each dispatch on a fresh SCRA certificate. A held account is never sent to a recovery agent, and a cancellation the agent does not acknowledge within 4 hours is escalated.

Does it check SCRA status and bankruptcy filings?

Yes. The bankruptcy and military checker searches the national bankruptcy index and the SCRA status site, keeps the certificate, and compares the active-duty start with the contract date. It never clears an account without both searches under 24 hours old, and these federal holds cannot be overridden.

Which state notices does it handle?

The notice each state requires after repossession — for example California’s notice of intent to dispose, Georgia’s notice of intent and right to redeem, and the notice of disposition in Texas, Florida and Arizona — from state rule packs reviewed by compliance. The deadline is the earlier of the state rule and your policy, the sale date the later, and every required content is checked before the recovery manager signs.

Does it work out reinstatement, redemption and deficiency amounts?

Yes. The notice writer itemizes the amount to reinstate and to redeem from the ledger and the contract. After the sale, the sale and deficiency calculator works out the deficiency or surplus line by line and drafts the explanation letter, with the refund for a surplus.

Do people stay in control?

Yes. Agents never assign, send, sell, waive or demand on their own. The recovery manager releases each batch, signs every notice and letter and approves refunds and waivers; any override of a hold needs a reason and the compliance reviewer.

Can we set our own holds, clocks and approvals?

Yes. Each hold and its window, the pre-dispatch and nightly checks, the cancellation acknowledgement time, the notice and sale policy, personal-property handling and who approves what are all settings, versioned and on the audit trail.

How long does it take to go live?

The Agentic Solution Engine builds and deploys it from your requirements — your recovery policy, state coverage, letter templates and a sample of past assignments — and it goes live once every quality gate has passed. We will walk you through it on your own repossessions first.
