What is Power of Attorney Acceptance?

Power of attorney acceptance is the work a bank or credit union does when someone presents a power of attorney: read it, check it against the law of the state where it was signed and the member's record, and accept it, ask for what the law allows, or refuse it with a reason, before the state's deadline. Power of Attorney Acceptance puts six agents on that review: they mark every clause with its passage and statute, count the clock, verify the agent and draft the letter. A POA Specialist decides, a second specialist checks, and Legal approves every refusal.

The problem

Why power of attorney acceptance runs up against the deadline

Power of attorney acceptance starts the moment a niece, a son or a friend hands a power of attorney across a branch desk. Where the Uniform Power of Attorney Act is law, the clock starts then: in Virginia and the District of Columbia the credit union must accept the document, or ask for an agent's certification, a translation or an opinion of counsel, within seven business days. Today the officer copies it and emails it to an operations mailbox, where a specialist reads six pages of legal text against a checklist and counts business days on a calendar. A hard one goes on to Legal and waits there.

Both mistakes are expensive. A wrongful refusal can bring a court order to accept and the presenter's attorney's fees, and a family left unable to pay a nursing home. A careless acceptance hands a member's savings to someone whose authority has not begun, because the power is springing, or has ended, because it was revoked. Branches still ask for "our form", which the Act does not allow. And once a power is accepted, nobody watches what the agent does with it.

One power of attorney acceptance, from the branch desk to the teller window

On Thursday, October 15, 2026 at 2:42 p.m., Corinne A. Vale presents a Durable General Power of Attorney at the Larkmoor branch of Norrell Federal Credit Union for her uncle, Walter E. Nyberg, 86, a member since 1979. It was signed in Virginia on March 18, 2024. Here is POA-26-11482, screen by screen, in the working solution.

  1. 01Tuesday morning

Every open power on its deadline day

    Tamsin Ruelas · POA Specialist

Tamsin's desk is a deadline week, not a grid: 47 open powers, 4 due in the next 2 business days, 9 waiting on an agent's reply, and 0 decided late in 2026 out of 3,652. Walter Nyberg's power sits on Mon Oct 26. Under Needs you, the agents have written one line each: Harold J. Brandvold's is due tomorrow with its refusal at Legal, Walter's is springing with no physician's determination, and Rosalind T. Feeney's is clear to accept.

"Each power sits on its deadline day · counted in business days."

  2. 02Thursday, 2:42 p.m.

Read in 3 minutes, in steps she can follow

    Document, Statute and Identity agents

Corey Halvorsen scanned the six pages and Corinne's Virginia driver's license at the desk, and the clock started at presentation. The Document agent read the pages and marked 9 clauses, 8 clear and 1 needing a person. The Statute agent applied Virginia law for validity and set the Virginia clock: presented Thu Oct 15, deadline Mon Oct 26. The Identity agent verified the license and found no earlier power, revocation or restriction on Walter's 3 accounts.

"Recommendation: Request certification · Handed to Tamsin Ruelas to decide."

  3. 03Mark 4

A springing power, caught in the margin

    Document agent

The instrument is the review. A numbered mark sits beside each clause: principal, agent and successor, durable language, when it takes effect, banking powers, gifts and survivorship, prior powers, signature and acknowledgment. Mark 4 opens the passage, its confidence of 0.99 and its source: the power takes effect only on Walter's incapacity, and no physician's determination is attached. Above it, the Virginia clock reads day 3 of 7.

"This power of attorney shall become effective only upon my incapacity. My incapacity shall be established by a written determination of my attending physician."

  4. 04One question

Can Corinne use the accounts today?

    Tamsin Ruelas · POA Specialist

Tamsin asks the power itself. The answer is no: the power is springing, and until the physician's determination and Corinne's certification arrive, accepting would let someone act whose authority has not begun. Each statement carries a numbered citation to page 3 of the instrument or to Va. Code § 64.2-1607.

"Tellers see 'may not transact yet' on Walter's profile."

  5. 0510:12 a.m.

The certification request, with its legal basis

    Drafting agent

Tamsin chooses Request certification. The Drafting agent's letter to Corinne asks for the attending physician's written determination and her agent's certification on the enclosed Virginia form, already filled in, and says the credit union will decide within five business days after receiving them. The legal basis line cites Va. Code §§ 64.2-1617, 64.2-1607(B), 64.2-1639 and 64.2-1618(A). Tamsin can edit it, with her changes tracked, then approves it as maker.

The Drafting agent never sends: a maker approves and a checker signs every letter.

  6. 06The checker

A second specialist checks the same evidence

Garrett Szymborski · POA Specialist, checker

Garrett sees Tamsin's choice beside the agents' recommendation, the same, with her reason, "Springing; no determination". Below it are the nine clause marks and the identity, member record, trusted contact and principal's activity checks she saw, each cited. He signs, or returns it with a reason code. If Tamsin tried to check her own decision, signing would be off, with the reason.

"I check the evidence, not the maker's confidence."

  7. 0710:19 a.m.

Sent, and the clock met on day 3

Garrett Szymborski · POA Specialist, checker

Once Garrett signs, the request goes to Corinne by email and first-class mail. The clock hatches the days after Tue Oct 20 as paused: the seven-day duty is satisfied on day 3, and acceptance is due within 5 business days after her reply. The authority card is prepared but does not post.

    "Waiting for Corinne's reply."

  8. 08Thursday, Oct 22

The reply read, and a new clock started

    Document and Statute agents

Corinne's reply arrives. The agents read her certification, signed under penalty of perjury on Wed Oct 21, and the written determination of Dr. Anselm Ivers, Walter's attending physician. Mark 4 is now clear. The new clock runs 5 business days from Thu Oct 22, with acceptance due Thu Oct 29, and the agents now recommend Accept.

  9. 09Accepted and checked

What Corinne may and may not do, account by account

    Authority agent

The Authority agent turns the accepted power into an authority card. Corinne may make deposits and withdrawals, transfer between Walter's own accounts, pay his bills and open or close accounts in his name. She may not make gifts, transfer to herself or to others, add a joint owner, change payable-on-death beneficiaries or delegate. A maker approves posting and a second specialist checks it before it reaches the core banking system and the branch platform.

Withheld powers are never inferred as granted (Va. Code § 64.2-1622).

  10. 10At the teller window

    Plain guidance for the branch

Corey Halvorsen · Member Service Officer

Walter's profile on the branch platform shows Corinne as his agent, accepted Thu Oct 22 and checked by Garrett Szymborski, with his SSN and date of birth masked. The teller guidance says it in plain words: she may transact as agent, but may not add owners, change beneficiaries or move money to herself. In her own online banking, transfers to her accounts are not available.

Built on the engine

6 agents. Each with one job, and hard limits.

Six agents mark every clause, run the state's clock, verify the agent, draft the letter and watch afterwards; two specialists sign.

Document agent

Reads each power, classifies it (durable, springing, limited, statutory form, language) and marks each clause in the margin with its passage, verdict and confidence: principal, agent and successor, durable language, when it takes effect, banking powers, gifts and survivorship, prior powers, signature and acknowledgment.

  • Never clears a clause under 0.95 confidence; below it, the clause goes to a person
  • Never guesses an unreadable page; it asks for a rescan
Statute agent

Applies the law of the state where the power was signed for its validity and meaning, and the acceptance rule of the state where it was presented; counts business days and holidays from presentation, knows what may be requested, restarts the clock on a reply, and recommends accept, request or refuse.

  • Uses only state rule tables Legal has approved
  • Never decides; an unknown state goes to Legal
Identity agent

Verifies the agent's ID captured at the desk, screens the agent, and checks the member record for earlier powers, revocations, holds, restrictions and trusted contacts.

  • Never matches a person on name alone
  • Never shows a referral
Drafting agent

Writes certification, translation and opinion-of-counsel requests, refusal letters with their legal basis, and receipts, and fills in the state's agent's certification form.

  • Never sends a letter
  • A maker and a checker on every letter, and Legal on every refusal
Authority agent

Turns an accepted power into an authority card on each account, what the agent may and may not do, with plain teller guidance, and posts it to the core banking system and the branch platform.

  • Never posts on one signature
  • Withheld powers are never inferred as granted
Watch agent

Follows each accepted agent's activity against the member's own 12-month pattern and the authority card, and opens a confidential elder-protection alert on a sharp change or an act the card withholds.

  • Never contacts the member or the agent, and never files
  • Alerts are visible only to elder protection, the BSA officer and audit
POA Specialist

Decides; a second specialist checks; Legal approves refusals. The agents propose; a named person decides.

Ask in plain words

Ask about any power, clause, clock or rule

Ask about the power in front of you, the desk or a rule, or ask for a letter to approve. Every answer cites the clause, the member record or the statute.

Can Corinne use the accounts today?

No. The power is springing: it takes effect only when his attending physician determines in writing that he is incapacitated. Until that determination and her certification arrive, accepting would let someone act whose authority has not begun. Tellers see "may not transact yet" on Walter's profile.

What if the reply never comes?

The 7-day clock is met by sending the request. If Corinne refuses to provide the certification, the credit union is not required to accept. The desk chases a missing reply at 10 business days, and Legal approves any refusal.

Can Martin Nyberg act instead?

Only if Corinne dies, resigns, becomes incapacitated or declines to serve. Martin is also Walter's trusted contact, which the specialist may use to check on Walter's wishes, without sharing account details.

Draft the refusal for Harold Brandvold's power

It is drafted and with Miriam Takahashi. Harold revoked the power on Feb 9, 2026; with actual knowledge of the termination, the credit union is not required to accept it. The letter states that basis in plain words. After Legal approves, Garrett Szymborski checks it and it is mailed, with a separate letter to Harold.

Questions

What deposit operations teams ask about power of attorney acceptance.

Can a bank refuse a power of attorney?

Where the Uniform Power of Attorney Act is law, only for the reasons the state's statute allows, such as a power the member revoked, a requested certification that is refused, or a good-faith belief the power is invalid. In Virginia a wrongful refusal can bring a court order to accept and the presenter's attorney's fees (Va. Code § 64.2-1618). Here every refusal carries a reason code and its legal basis, and goes to Legal for approval and a checker's signature before the letter leaves.

How long does a bank have to accept a power of attorney?

It depends on the state where it is presented. In Virginia and the District of Columbia it is 7 business days to accept or to request a certification, translation or opinion of counsel, then 5 business days after the reply; the New York table uses 10 and 7. The Statute agent counts from presentation as day 0, skips the holidays in the approved calendar, and the desk alerts the specialist at day 5 and the manager at day 6.

What happens with a springing power of attorney?

A springing power takes effect only on an event, usually the principal's incapacity, so the agent may not act until that event is shown. The Document agent flags when it takes effect as a clause that needs a person, the recommendation becomes a request for the determination and the agent's certification, and tellers see "may not transact yet" until the power is accepted.

What is an agent's certification, and when does it ask for one?

An agent's certification is the agent's signed statement, on the state's form, of facts about the power, such as that it has not been revoked and that the event it depends on has occurred. When a clause needs proof, the Drafting agent writes the request with its legal basis and fills in the form for the agent to sign. Sending the request meets the seven-day duty, and the clock restarts when the reply arrives.

Does it watch the agent after the power is accepted?

Yes. The Watch agent compares each accepted agent's activity with the member's own 12-month pattern and the authority card, and raises a confidential alert on a sharp change, a transfer to the agent's own account over $2,500, a burst of new payees, or an act the card withholds. The Elder Financial Protection Specialist decides, and a hold needs a checker.

Do people stay in control of the decision?

Yes. The agents recommend and explain; they never decide, send a letter, post an authority card or contact a member. A specialist decides, a different specialist checks, Legal approves every refusal, and any agent finding can be overridden with a reason code and a note, all on the audit trail.
